U.S. DOL W&H Recovered $441K for 45 Mechanical Workers of Labor Broker under Charles A. Klein & Sons, Inc. and Gilbane Residential Company, LLC at MDXL Flats Affordable Housing Development in D.C.

The U.S. Department of Labor's Wage & Hour Division ("WHD") recently recovered $441K in back wages for 45 mechanical workers of Day-Debut Mechanical, Inc. (“Day-Debut”) at the MDXL Flats affordable housing project in SW D.C. (“MDXL”).  Day-Debut of Alexandria, VA, formerly known as Day CJ Plumbing & Mechanical, Inc. of Libertytown, Maryland (“Day CJ”), was a second-tier plumbing and HVAC subcontractor to the general contractor, Gilbane Residential Company, LLC (“Gilbane”).  Gilbane had entered into a construction contract with project owner, TM Jacob 1530 LLC for the development comprising 11 stories with 101 affordable housing rental units and approximately 8,000 square feet of commercial space.  Day-Debut was contracted by first-tier subcontractor, Charles A. Klein & Sons, Inc. (“CAK”).  Both of CAK’s down-tier Davis-Bacon subcontracts for the plumbing and HVAC were under Day CJ’s name.


TM Jacob 1530 LLC obtained a $13,065,659 loan from the District of Columbia Department of Housing & Community Development (“DHCD”), through D.C.’s Housing Production Trust Fund (“HPTF”) via U.S. Housing & Urban Development, as financing for the $36,008,870 MDXL, which was subject to Davis-Bacon labor standards (contract number DHCD 2021-272).
